在留資格「興行（こうぎょう）」に関する上陸許可基準が、令和5年に改正されました。これにより、外国人アーティストやプロスポーツ選手の受け入れがより柔軟になり、日本の文化・芸術・スポーツ分野に新しい広がりが生まれています。

In 2023, Japan revised the landing permission standards for the “Entertainment” (Kogyo) visa. The new rules allow for more flexible acceptance of foreign artists and professional athletes, bringing new opportunities for cultural, artistic, and sports activities in Japan.

改正の背景：国際的な文化交流の広がりと制度の見直し

在留資格「興行」は、外国人の芸能人やプロスポーツ選手などを日本に招き、国民に娯楽を提供するための在留資格です。演劇・演芸・歌謡・舞踊・演奏といった舞台芸術や、プロスポーツの試合・イベントが対象となります。商品の宣伝のためのショーなども含まれています。

近年、世界各地からアーティストやパフォーマーが日本に招かれる機会が増え、舞台だけでなくフェスやイベント、文化交流プログラムなど活動の場も多様化しています。しかし従来の上陸許可基準は、主にクラブやキャバレーなど「営業施設」での実演を前提としたものであり、現代の多様な文化活動に十分対応できていない面がありました。

国際的な文化・芸術交流を進めるためには、信頼できる機関を通じた柔軟な受け入れが欠かせません。こうした背景から、法務省は制度の見直しに踏み切りました。令和5年5月31日に告示が行われ、8月1日から新しい基準が施行されています。改正の目的は、外国人アーティストやスポーツ選手の受け入れを促進し、国際的な文化交流をより活発にすることです。

The “Entertainment” visa is designed to invite foreign entertainers and professional athletes to Japan to provide cultural and recreational activities for the public. It covers stage performances such as plays, music, dance, singing, and professional sports events, as well as promotional shows for products.

In recent years, Japan has hosted more artists and performers from around the world. Their activities now take place not only on traditional stages but also at festivals, events, and cultural exchange programs. However, the previous landing standards were mainly based on performances at “business establishments” such as clubs and cabarets, which did not fully reflect the diversity of modern cultural activities.

To promote international cultural exchange, it became essential to create a more flexible system that can work through reliable host organizations. Against this backdrop, the Ministry of Justice revised the system. The new standards were announced on May 31, 2023, and took effect on August 1. The goal of the revision is to encourage the acceptance of foreign artists and athletes and to further activate cultural exchange on a global scale.

「興行」ビザの基本と活動の区分

「興行」の在留資格では、活動内容が「興行」に該当するかどうか（該当性）と、上陸許可基準を満たしているか（適合性）の2点が求められます。在留期間は3年・1年・6か月・3か月・30日です。

活動内容は大きく次の2つに分類されます。

従来は営業施設での活動が中心でしたが、今回の改正では、信頼できる受け入れ機関であれば営業施設以外でも活動が認められるようになっています。

For the “Entertainment” visa, two conditions must be met: (1) whether the activities fall under the “Entertainment” category (eligibility), and (2) whether they meet the landing permission standards (compliance). The permitted period of stay is 3 years, 1 year, 6 months, 3 months, or 30 days.

Activities are broadly divided into two categories:

• Entertainment activities: stage performances such as plays, music, dance, singing, and sports events at theaters and halls.
• Other artistic activities: activities outside the stage, such as TV appearances, film shoots, advertising, choreography, and artistic direction.

Previously, most activities were limited to business establishments. Under the new rules, if the host organization has a solid track record, activities can now be conducted outside of these venues as well.

改正の内容と具体的なポイント

今回の改正には、大きく2つのポイントがあります。

1. 実績ある招へい機関への柔軟な対応
2. 要件緩和の対象となる外国人の拡大

① 実績ある招へい機関への柔軟な対応 従来、演劇や演芸、歌謡、舞踊などの活動はクラブやキャバレーなど営業施設が中心でした。改正後は、適切な実績を持つ招へい機関が外国人を招く場合、営業施設以外の場所でも活動が認められるようになりました。

② 要件緩和の対象となる外国人の拡大 新しく外国人を受け入れる場合でも、過去の実績などから適切に活動ができると判断される人については、上陸許可基準の一部が緩和されるようになりました。これにより、信頼できるアーティストやスポーツ選手の来日手続きがスムーズになります。

There are two major points in this revision:

1. More flexibility for trusted host organizations
2. Relaxation of requirements for foreign individuals with a good track record

① Flexible rules for trusted host organizations Previously, stage activities like plays, music, or dance were mainly conducted at clubs and cabarets. With the revision, if a host organization has a solid track record, performances can now take place at other venues such as theaters, halls, or cultural facilities.

② Expansion of relaxed requirements for certain foreigners Even for first-time applicants, if they have a proven track record of appropriate activities, some landing requirements may be relaxed. This helps trusted artists and athletes enter Japan more smoothly.

スポーツ・芸能活動の具体的な取り扱いと制度の広がり

芸能やスポーツの活動内容によっては、「興行」以外の在留資格が適用される場合もあります。例えば、経営者であれば「経営・管理」、教育活動であれば「技術・人文知識・国際業務」が該当することもあります。

プロスポーツ選手については、競技や契約形態により細かい基準があります。

種目	興行該当性
サッカー（J1・J2）	原則として興行に該当
サッカー（J3）	状況により「興行」または「技能」など
プロ野球選手	興行に該当
その他競技	所属リーグや契約内容により判断

テレビ・映画出演、広告撮影、モデル活動、芸術監督や振付といった舞台以外の芸能活動も「興行」に含まれます。ただし、舞台での実演とは審査の観点が異なります。契約内容や活動期間、活動場所などが慎重に確認され、上陸許可基準との適合性が審査されます。

今回の改正によって、日本で文化・芸術・スポーツ活動を行いたい外国人にとって、制度がより現実的で柔軟なものになりました。実績ある機関を通じれば、営業施設以外での活動も可能になり、国際交流の幅が広がっています。

Depending on the type of activity, other visa categories may apply. For example, “Business Management” applies to managerial roles, while “Engineer/Specialist in Humanities/International Services” applies to teaching or cultural education roles.

For professional athletes, the applicable standards vary depending on the sport and the nature of their contracts.

Similarly, “other artistic activities” such as TV appearances, film shoots, and modeling are handled differently from stage performances. Authorities check contracts, activity duration, and venues carefully during the review.

This revision makes the system more practical and flexible for foreigners who wish to engage in cultural, artistic, or sports activities in Japan. Through trusted organizations, performances can now be held at various venues, expanding opportunities for international exchange.
